AND WAIVER OF LIABILITY AND RELEASE FORM

This document must be completed and signed to obtain access to any recreational amenities owned or operated by St. Vrain Lakes Metropolitan District No. 1 (the “District”).

1. DISTRICT RECREATION AMENITIES This form applies to all District recreational amenities, including but not limited to swimming facilities, the Cove, fitness center, playgrounds, lakes, parks, and trails (each a “Facility” and collectively, the “Facilities”).

3. MINORS Minors must be accompanied by a Property Owner or an Additional Authorized User at all times unless a Minor Release Form is on file with the District Manager. Please list all minors residing in the household:

ADDITIONAL AUTHORIZED USERS (ADULTS ONLY) Additional Authorized Users may include: Adult children (18+) Tenants/Renters Regularly employed caregivers (nanny/babysitter) Immediate family residing at the property address (including grandparents or grandchildren) Other individuals residing at the property address (proof of residency may be required) Additional Authorized Users do NOT include guests. Guest access is subject to District policies. Guest passes may be purchased at The Cove during operational business hours. Please refer to the Recreation Amenity Fee Schedule. 6. ACKNOWLEDGMENT OF RISK

I acknowledge that participation in recreational activities, including but not limited to swimming, boating, fishing, exercising, running, and climbing (each a “Recreational Activity” and collectively, the “Recreational Activities”), on, in, or around the Facilities involves inherent risks. These risks may include bodily injury, slipping and falling, cardiovascular stress, drowning, permanent disability, death, damage to personal property (including vehicles and watercraft), exposure to inclement weather or toxic microorganisms, insect or animal bites, and other social or economic losses. Such risks may arise from my actions or inactions, the actions or inactions of my child/ward, guests, or others, the condition of the Facilities, or the negligence of the District. I understand that not all risks can be anticipated and voluntarily assume all known and unknown risks. (required)

7. PHOTOGRAPHY AND MEDIA RELEASE

I acknowledge that I and/or my child/ward may be photographed or recorded while using the Facilities. I grant permission for the District and/or Barefoot LLC to use such images or recordings for promotional or informational purposes without compensation.

8. RESPONSIBILITY FOR ACTIONS

I acknowledge that I am legally responsible for my own actions and, if applicable, for the actions of my child/ward, Additional Authorized Users, and any guests I bring onto District property, including responsibility for any damage to public or private property or personal injury.

9. RELEASE, WAIVER, AND INDEMNIFICATION

In consideration for being permitted to access and use the Facilities, I hereby release, waive, discharge, and covenant not to sue St. Vrain Lakes Metropolitan District No. 1, its officers, directors, employees, agents, consultants, representatives, contractors, and management companies, including Barefoot LLC (collectively, the “Released Parties”), from any and all claims, demands, actions, or causes of action arising out of or related to any injury, loss, damage, or death suffered by me or my child/ward, whether caused in whole or in part by the negligence of the District or the Released Parties. I further agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising from my participation, my child/ward’s participation, or the participation of any Additional Authorized Users or guests. This Release is binding upon me, my child/ward (if applicable), Additional Authorized Users, and our respective heirs, assigns, personal representatives, and next of kin.
